Acceptable Use Policy Please Read Carefully This Acceptable Use Policy contains important information about your (the “User”) account with Broadlink Wireless, Inc. (“Broadlink”) Account. Your access to internet services and all other services provided by Broadlink shall be referred to as the “Services”. You should read this carefully and fully understand its terms as your use of any Broadlink service shall constitute your acceptance of this Acceptable Use Policy. Furthermore your signature'(s) on any Broadlink application shall also constitute your acceptance of this Acceptable Use Policy. This Acceptable Use Policy supersedes all previous representations, understanding or agreements made by Broadlink Broadlink reserves the right to alter, amend and/or modify this Acceptable Use Policy as well as and change the content and pricing of its services at any time without notice.
Disclaimer of Liability. Broadlink exercises no control over the content of the information passing through its systems and makes no warranties of any kind, expressed or implied, for services provided. Broadlink disclaims any warranty of merchantability or fitness for a particular purpose. Broadlink is not responsible for any damage suffered from the direct or indirect use of its services including, but not limited to: expenses and loss of data resulting from delays, non‑deliveries, mis‑deliveries, or service interruptions caused by negligence of any kind, errors or omissions. Use of any information obtained Broadlink is at your own risk.. Broadlink specifically denies any responsibility for the accuracy or quality of information obtained through its services.
Restrictions. Access provided by Broadlink may only be used for lawful purposes, and any use of the Services to transmit any material whether by email, uploading, posting, or otherwise that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder shall be a violation of this Acceptable Use Policy.
You agree to comply with the rules and restriction appropriate to other networks or services connected directly or indirectly to Broadlink including, but not limited to any Acceptable Use Policies established for the Internet as a whole which expressly prohibits commercial solicitation.
You agree to indemnify, hold harmless and defend Broadlink from any claims resulting from your conduct and/or use of the Services.
Using the Services for any of the following uses is STRICTLY PROHIBITED and shall constitute a violation of this Acceptable Use Policy: To harm, or attempt to harm, minors in any way; To transmit any material whether by email, uploading, posting, or otherwise that threatens or encourages bodily harm or destruction of property; To transmit any material (by email, uploading, posting, or otherwise) that harasses another; To make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as “pyramid schemes,” “Ponzi schemes,” and/or “chain letters;” For Adding, removing or modifying identifying network header information in an effort to deceive or mislead; Attempting to impersonate any person by using forged headers or other identifying information. Please Note: The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers (‘munging” headers) in news postings in order to avoid spam email address collectors is allowed; To transmit any unsolicited commercial email or unsolicited bulk email; Participating in or facilitating activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature; To access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Broadlink or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data; To transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software; To collect, or attempt to collect, personal information about third parties without their knowledge or consent; Reselling the Services without Broadlink’s authorization. Participating in any activity which adversely affects the ability of other people or systems to use Broadlink Services or the Internet. This includes but is not limited to: 1) Uses which consume an excessive amount of bandwidth, (which determination shall be in the sole discretion of Broadlink; and, 2) “Denial of service” (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the User’s responsibility to ensure that their network is configured in a secure manner. A User may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A User may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Using a personal account for high volume or commercial use. The Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Users may stay connected so long as they are actively using that connection for the above purposes. Users may not use the Services on a standby or inactive basis in order to maintain a connection. Pinging is expressly prohibited. Accordingly, Broadlink maintains the right to terminate any User’s connection following any extended period of inactivity as solely determined by Broadlink. All Broadlink Users receive free webspace for use with their Internet access account. Each User’s free webspace is allocated a certain amount of traffic per month (traffic is monitored, calculated and determined in the sole discretion of Broadlink) If a site exceeds its maximum monthly allotment of traffic, the site will become unavailable until the beginning of the next calendar month. A site that exceeds the User’s maximum allotment in size will also become unavailable. Unavailability includes but may not be limited to the inability to access the site publicly or to publish to or modify the site's contents via certain Web creation tools.
Other Rights and Obligations.
Payment is due under
the terms of your subscription agreement (“Subscription Agreement”)
with Broadlink Accounts are in default if payment is not received
within 10 days of its due date. Accounts in default may be
suspended. Such termination does not relieve You from paying past
due and ongoing charges. Reactivation of account will incur an
additional setup fee. After Your initial subscription period has
expired, only a written request, thirty (30) days in advance, to
terminate Your Service relieves You of Your obligation to pay
further account charges. It does not relieve You of past obligations
and charges. If You default, You agree to pay Broadlink reasonable
expenses, including reasonable attorney and processing fees,
incurred in enforcing its rights under any Subscription Agreement
and this Acceptable Use Policy. Broadlink reserves the right to refuse service to anyone, and to terminate any account at any time. Broadlink reserves the right to reasonably remove or modify, at it’s sole discretion, any material in violation of these policies. |
